These Terms and Conditions govern your use of WBPicker, the Weibo comment picker operated by Maetheon. By creating an account, starting a trial, or otherwise using the service, you agree to these terms. If you don't agree with them, please don't use the service. We've kept the language as direct as we can so you know what you're agreeing to.
The service
WBPicker is a tool that selects random winners from the public comments and interactions on a Weibo post you provide. It's designed for running giveaways and contests. We provide the tool; you provide the posts and decide how to run your own promotions. We don't run your giveaway for you, and we aren't a party to it.
Free trials
New users receive 3 free trials. A trial is a full draw, so you can test the tool on real posts before paying. Trials are offered as a courtesy to help you decide whether WBPicker fits your needs, and we may change the number or terms of trials over time. Once your trials are used, continued use requires a paid plan.
Accounts
To use most features, you'll need an account. You're responsible for keeping your login details private and for everything that happens under your account. If you suspect someone has accessed your account without permission, tell us at [email protected] so we can help secure it. You agree to give us accurate information when you sign up and to keep it current.
Plans and payment
Paid plans unlock additional draws and larger comment capacities. The current options and prices are listed on our pricing page at https://wbpicker.com/pricing. By subscribing, you authorise us, through our payment processor, to charge the fees for the plan you choose. Unless stated otherwise, subscriptions renew automatically for the same period until you cancel. You can cancel at any time, and your plan will remain active until the end of the period you've already paid for. Fees already paid are generally non-refundable except where required by law or where we decide otherwise at our discretion.
Acceptable use
We ask that you use WBPicker honestly and lawfully. You agree not to use the service to run promotions that are illegal, fraudulent, or deceptive; not to attempt to break, overload, or reverse-engineer the tool; not to use it to harass anyone or to scrape data for purposes unrelated to running a legitimate giveaway; and not to misrepresent the results of a draw to your audience. You're also responsible for following Weibo's own rules and any laws that apply to running contests where you live. If you run a promotion, the legal responsibility for that promotion is yours, not ours.
Your responsibility for your giveaways
This one matters, so we'll say it plainly. The giveaways and contests you run are yours. You set the rules, you decide the prize, and you're responsible for delivering it to the winner and for complying with any laws about promotions, taxes, and disclosures in your jurisdiction. WBPicker is the tool that picks the winner; it does not make you compliant with the law, and it isn't responsible for how you handle the promotion around it.
Intellectual property
The WBPicker name, the site, the software, and everything we've created to deliver the service belong to Maetheon and are protected by intellectual property laws. We grant you a limited, personal, non-transferable right to use the service while your account is in good standing. You don't get any ownership of the tool, and you agree not to copy, resell, or build a competing product out of it.
Service availability
We work to keep WBPicker available and running well, but we don't promise it will be uninterrupted or error-free. We may need to take the service down for maintenance, updates, or reasons outside our control. We also rely on Weibo's public data being accessible; if Weibo changes how its posts or comments work, parts of the tool may be affected, and that's not something we can always foresee or prevent.
Disclaimers
The service is provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties of any kind about the service, including that it will meet your particular needs or produce a specific outcome for your giveaway. The draws are random, and randomness is exactly what you're getting; we don't warrant any commercial result from running a promotion.
Limitation of liability
To the extent permitted by law, Maetheon won't be liable for indirect, incidental, or consequential damages arising from your use of WBPicker, including lost profits, lost goodwill, or problems with a promotion you ran. Where liability can't be excluded, our total liability to you is limited to the amount you paid us for the service in the twelve months before the claim arose.
Termination
You can stop using WBPicker and close your account at any time. We may suspend or end your access if you breach these terms, misuse the service, or where we're required to by law. If your account ends, the parts of these terms that should reasonably survive, such as the disclaimers and liability limits, will continue to apply.
Changes to these terms
We may update these terms as the service changes. When we make a material change, we'll update the date here and, where appropriate, notify you. If you keep using WBPicker after a change takes effect, that counts as accepting the new terms.
Governing law
These terms are governed by the laws applicable to Maetheon's place of operation, without regard to conflict-of-law rules. Any dispute will be handled in the courts that have jurisdiction there, unless the law that protects you as a consumer says otherwise.
